Equitable Traditionalism & Constitutional Law

We are excited to invite you to attend our 2026 Symposium, Equitable Traditionalism and Constitutional Law. This symposium, produced in partnership with the Center on the Structural Constitution at Texas A&M University School of Law, will be held on campus in Thorne Auditorium Friday, October 23, 2026.

This Symposium will analyze the Court’s turn toward history and tradition as the measure of equitable remedies in constitutional litigation. It will explore the impact of the historical turn on federal courts’ use of equity power in defense of fundamental rights and governmental prerogatives—and will advance arguments both supporting and questioning those moves. Symposium sessions include:

• A conversation with the Honorable Stephanos Bibas, United States Court of Appeals for the Third Circuit, on equitable traditionalism and the judicial role
• Preliminary equitable relief and the “shadow docket”
• The provenance and path forward for Ex parte Young injunctions
• Interactions of equitable traditionalism with unitary-executive theory and the consequences for administrative law

Panelists include Northwestern’s own Professors Jim Pfander and Monica Haymond, Professor Larry Solum (Texas A&M), Professor Sam Bray (Chicago), Professor Mila Sohoni (Stanford), Professor Neil Siegel (Texas A&M), Professor Katherine Mims Crocker (Cornell), Professor Emily Bremer (Notre Dame), and more!
